The term eminent domain refers to the process by which the government takes private property away from private owners just to convert it into public property, offering the private owners fair compensation.

The process of eminent domain is regulated by the Fifth Amendment of the Constitution that forbids the government to take away land without proper compensation offered to the private owners. After the government identifies the plot of land to be taken through the process of eminent domain, the owner of the plot must be notified regarding the government’s intention. The notification is taken care of by a person assigned by the government to meet the property owners and to discuss the terms with them. The amount offered by the government for a specific plot is determined by many different factors, including the features of the property and the scope for which the property will be used.
